Since the beginning of the war against Ukraine, Russian military courts have heard or sentenced 144 individuals accused of desertion, Article 338 of the Russian Criminal Code, or unauthorized abandonment of a unit, Article 337 of the Criminal Code, who were also charged with murder, Article 105 of the Criminal Code, and intentional infliction of grievous bodily harm resulting in death, Part 4 of Article 111 of the Criminal Code. This was reported by Sever.Realii , which examined databases on the websites of Russian military courts from 2022 to April 21, 2026. According to this information, AWOL were the most frequently convicted of murder: 54 service members were charged under these charges.

In the remaining cases, the analysis shows that either the trial has not yet concluded, the case was dismissed due to the defendant’s death, suspended, or "there is no real possibility for the defendant to participate in the trial." The number of deserters and AWOL accused of murder is rapidly growing, according to court data. While only one person was convicted of such crimes in 2022, 86 service members were tried for such crimes in 2025. Journalists have identified 25 cases of service members who deserted the army and are accused of murder, which are scheduled for trial in 2026.
