Antoinette Lattouf has won her unlawful termination case against the ABC and been awarded $70,000 in compensation.
The journalist was taken off air partway through a casual radio presenting contract in Sydney in December 2023, after sharing a post from Human Rights Watch about the war in Gaza on her Instagram.
She claimed she was sacked because of her political opinions and/or race, and that the decision was influenced by external pressure from pro-Israel lobbyists.
The ABC denied those claims and argued she was paid for the whole contract, but wasn’t required to present the last two shifts.
In the Federal Court, Justice Darryl Rangiah found Ms Lattouf was given advice to not post anything controversial about the conflict, rather than an official directive.
The judge found the ABC contravened the Fair Work Act by terminating Ms Lattouf’s employment for reasons including that she held a political opinion opposing the Israeli military campaign in Gaza.
